Which law applies to a French estate?
Under EU Succession Regulation No 650/2012, the law of the country of the deceased’s last habitual residence generally applies. However, nationals of an EU Member State may choose the law of their nationality to govern their estate by making a declaration in their will.
Do I have to pay inheritance tax in France if I live abroad?
French inheritance tax may apply where the deceased was resident in France, where a beneficiary is resident in France, or where assets — notably French real estate — form part of the estate. Bilateral tax treaties concluded by France with certain countries may in some cases avoid double taxation.
What are the inheritance tax allowances in France?
A child benefits from a tax-free allowance of €100,000 per parent, renewable every 15 years. The applicable rate then depends on the degree of kinship and the value of the estate.
What are the deadlines for a French estate?
The French inheritance tax return must generally be filed within six months of death. Where the deceased died abroad, this deadline is extended to twelve months.
Do I need a lawyer when buying real estate in France?
In France, the notaire handles the conveyancing process but acts neutrally. Legal advice from an independent lawyer is particularly valuable when reviewing the preliminary contract, the sale agreement and any cross-border tax considerations.
How does buying real estate in France work?
The process takes place in two stages: the signing of a preliminary contract (promesse de vente or compromis de vente), followed by the signing of the final deed of sale before a notaire. The buyer has a 10-day cooling-off period after signing the preliminary contract.
Can real estate in France be transferred tax-efficiently?
Yes — in particular through a gift of the bare ownership (nue-propriété) of the real estate while retaining the usufruct. Careful planning allows the allowances to be used every 15 years, significantly reducing the tax burden for the next generation.
